Any ideas on what might be causing this ?(that is a yellow utility flag at the very top)

It looks hungry to me. Try a slow release, balanced fertilizer like Scotts Nursery Special (at Lowes). Looks like it has some competition for water and fertilizer from the grass too. Also, make sure the soil is not compacted around it.

On the other hand, it may be suffering from depression. What did it do to deserve being in jail?
